These Terms and Conditions govern the provision of shipping, logistics, freight forwarding, courier and related services by Pixel Route Solutions, a shipping business organized and operating under the laws of Jamaica, with its principal place of business at Stony Hill, St. Andrew. By requesting, booking or using our Services, you the Customers agree to be bound by these Terms.

 

1. Definitions

  • Consignment / Shipment: Goods, documents or items tendered to the business for transport under a single booking.

  • Carrier: The business and/or any third-party carrier, subcontractor or agent engaged by the Business.

  • Bill of Lading / Waybill: Any shipping document, electronic or physical, issued by or on behalf of the Business.

  • Business Day: Any day excluding Sundays and public holidays in the place of shipment.

2. Scope of Services

·       The Business provides domestic and international shipping and logistics services, which may include transportation by land, sea, or air, warehousing, customs brokerage and related services.

·       The Business may subcontract all or part of the Services to third parties without prior notice to the Customer.

 

3. Customer Obligations

The Customer warrants that:

  • All information provided regarding the Shipment is complete, accurate and truthful.

  • The Shipment is properly packed, labeled and suitable for transport.

  • The Shipment complies with all applicable laws, regulations and customs requirements.

The Customer is responsible for:

  • Obtaining all required permits, licenses and approvals.

  • Paying all applicable duties, taxes, fees and charges.

  • Ensuring that prohibited or restricted items are not included in the Shipment.

4. Prohibited and Restricted Items

The Business will not transport prohibited items, including but not limited to:

  • Illegal goods

  • Hazardous or dangerous materials (unless expressly agreed in writing)

  • Firearms, ammunition, explosives

  • Perishable goods without prior written agreement

  • Currency, precious metals or valuables (unless declared and accepted)

The Business reserves the right to refuse, hold, return or dispose of any Shipment containing prohibited or undeclared restricted items at the Customer’s expense. Any prohibited or restricted items found will be confiscated by the Jamaica Customs and any fees given relating to this will also be at the customer's expense.

 

5. Rates, Charges and Payments

·       Rates are based on weight, volume, dimensions, destination and the nature of the goods. Rates are subjected to be change without prior notice.

·       All invoices are payable within [7] days from the invoice date unless otherwise agreed in writing.

·       Late payments may accrue interest at [1.5] % per month or the maximum rate permitted by law.

The Business may charge additional fees for:

  • Customs inspections or delays

  • Storage or demurrage

  • Re-delivery or address corrections

  • Fuel surcharges and taxes

  • Using our bank debit or credit card for online purchases on behalf of the customer.

Storage and Uncollected Goods:

Where the Customer or consignee fails to collect a Shipment within seven (7) days of arrival, notice, or availability for pickup (whichever occurs first), the Business reserves the right to charge storage fees at a daily rate determined by the Business. Such fees shall accrue automatically and be payable on demand. The Business may, after reasonable notice, move, store, return, sell or dispose of the goods at the Customer’s expense.

 

6. Delivery and Transit Times

·       Any quoted delivery or transit times are estimates only and not guaranteed.

·       The business shall not be liable for delays caused by events beyond its reasonable control, including but not limited to weather conditions, customs delays, strikes, acts of government or force majeure events.

 

7. Inspection and Right of Refusal

·       The Business reserves the right, but is not obligated, to open and inspect any Shipment for security, safety or compliance purposes.

·       The Business may refuse to accept or continue transport of any Shipment that does not comply with these Terms.

 

8. Limitation of Liability

To the fullest extent permitted by law, the Business’s liability for loss of or damage to a Shipment shall be limited to the lesser of:

  • The limits prescribed by applicable international conventions (including, without limitation, the Hague-Visby Rules, Montreal Convention, CMR), whichever is lower.

  • The Company shall not be liable for any loss, damage, or delay to packages during transit. In the event of loss or damage, the Company’s maximum liability shall be limited to the declared value of the package, up to a maximum of 100 USD. For packages valued at 100 USD or less, the Company will compensate the full declared value. For packages valued above USD 100, the Company’s liability shall not exceed 100 USD.

The Business shall not be liable for:

  • Indirect, consequential or special damages.

  • Loss of profit, market, or use.

  • Delays in delivery.

 9. Insurance

·       The Company does not provide insurance coverage unless expressly agreed in writing.

·       The Customer is responsible for arranging adequate insurance coverage for the Shipment if desired.

 

 10. Claims

Any claim for loss or damage must be submitted in writing within:

  • [2] days from delivery for visible damage, or

  • [5] days from the expected delivery date for non-delivery.

 Failure to submit a claim within the specified period shall constitute a waiver of the claim.

 

11. Indemnification

The Customer agrees to indemnify and hold harmless the Company from any claims, losses, fines, penalties or expenses arising from:

  • Breach of these Terms

  • Inaccurate or incomplete information

  • Violation of applicable laws or regulations

 

12. Force Majeure

The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control, including acts of God, war, terrorism, pandemics, labor disputes or governmental actions.

 

13. Termination

The Company may suspend or terminate Services immediately if the Customer breaches these Terms or fails to make timely payment.

 

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kingston.

  

15. Amendments

The Company reserves the right to amend these Terms at any time. Updated Terms will be effective upon publication or notification.

 

16. package consolidation

Light package consolidation services for shipments that meet the following criteria:

  • Number of packages: 2–3 packages only

  • Total combined weight: Less than 5 pounds (2.3 kg)

If multiple packages for the same recipient arrive within the same timeframe and meet these limits, we will consolidate them into a single shipment before dispatch. This will help reduce shipping costs, handling time and packaging waste.

Important Notes:

  • We do not consolidate shipments exceeding 3 packages.

  • We do not consolidate shipments with a combined weight over 5 lb.

  • We do not consolidate fragile, perishable, or time-sensitive items unless prior approval is given.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

18. Entire Agreement

These Terms constitute the entire agreement between the Company and the Customer regarding the Services and supersede all prior agreements or understandings.
